Asbestos Regulations.Asbestos regulations were first introduced in 2002 with the Control of Asbestos at Work Regulations (CAWR 2002). These were superseded in 2006 with the Control of Asbestos Regulations (CAR 2006) and these have more recently been revised with the Control of Asbestos Regulations 2012 (CAR 2012).

Regulation 4 of CAR 2012 sets out the Duty to Manage Asbestos. This imposes a duty of care for asbestos control and management on the duty holder who may be the owner of the property, landlord or the manager of the business within the premises. This asbestos legislation covers non-domestic properties and the communal areas of domestic dwellings, such as blocks of flats.

Regulation 10 of CAR 2012 relates to asbestos training for anyone likely to be exposed to asbestos such as trades people, contractors and staff and ensures safe working practices.

In order to deal with and control asbestos, your property may well require an asbestos survey to be undertaken, known as an Asbestos Management Survey (previously known as a Type 1 or Type 2 Asbestos Survey) which will highlight any asbestos work required.

The regulations also specify that if you are carrying out asbestos removal, major refurbishment or demolition work, an asbestos survey should be undertaken prior to these works taking place. This is also supported by the Construction Design Management Regulations 2007 (CDM2007). In this instance it would be necessary to carry out a Refurbishment or Demolition Survey (previously known as a Type 3 Asbestos Survey).
